This function implements the Contractor Requirements of DOE Order 442.1A - Employee Concerns Program as well as the UC/LBNL Whistleblower and Whistleblower Protection Policies.

Employees have the right – and the responsibility – to identify and report improper governmental activities and environment, health and safety concerns and to do so without fear of reprisal. Employees are encouraged to discuss concerns with their immediate supervisor, any level of management, or their human resources representative. In cases where employees (including subcontractor employees*) for any work at a DOE-owned or leased facility) or others are unable or do not wish to raise issues to management, are uncomfortable doing so, or wish to report retaliation, alternative mechanisms for reporting are available. In all cases, employees have the right to a respectful, prompt and effective response to their concerns.

Whistleblower Complaints

In accordance with University policy, LBNL has designated a Locally Designated Official to receive allegations of improper governmental activity and an Investigations Workgroup, comprising senior operations management, to review investigations of such allegations. The Charter of the Investigations Workgroup is available here. To learn more about the Laboratory policies for reporting and investigating allegations of improper governmental activities, go to (RPM Sections 2.05 J). Employees may file complaints directly with the Department of Energy Office of Inspector General or the DOE Employee Concerns Program. See "How To Report" below.

Whistleblower Protection

State and Federal regulations and Laboratory policy prohibit retaliation for engaging in protected disclosures/covered activities. See the Laboratory's Whistleblower Protection Policy for filing requirements and procedures. Click here for the Whistleblower Retaliation Complaint Form.

Contract 31, Clause I.61, provides Laboratory employees and subcontractor employees* with whistleblower protection under 10 CFR 708, the DOE contractor employee protection program; contact the DOE Office of Hearings and Appeals for more information, including how to file a complaint under 10 CFR 708.

Contract 31, Clause I.151 provides Laboratory employees and subcontractor employees with alternate whistleblower protection under 48 CFR 3.908. Read the details here.

The Federal Acquisition Regulation (FAR) Pilot Program has implemented enhanced whistleblower protections for employees of Federal contractors and subcontractors for the period from July 1, 2013 through January 1, 2017. Read more

The Office of Inspector General (OIG) maintains a Hotline to facilitate the reporting of allegations of fraud, waste, abuse, or mismanagement in U.S. Department of Energy (DOE) programs or operations. If you wish to report such allegations, you may call, send a letter, or email the OIG Hotline as identified at the left. Allegations may be reported by DOE employees, DOE contractors and subcontractors, or the general public.

Issues that should be reported:

  • Abuse of funds provided under the American Recovery and Investment Act of 2009 and retaliation complaints
  • Contract, Procurement, and Grant Fraud
  • Environment, Health, and Safety Violations
  • Computer Crimes
  • Product Substitution and Suspect/Counterfeit Parts
  • Bribery, Kickbacks, and Gratuities
  • False Statements and False Claims
  • Conflicts of Interest and Ethics Violations
  • Travel Fraud
  • Theft and/or Abuse of Government Property
  • Retaliation for Reporting Such Allegations to the OIG
  • Other Violations of Federal Laws and Regulations

Callers are encouraged to provide relevant and specific details of their complaints, including the identity of the person, company, or organization alleged to have engaged in wrongdoing; a description of the alleged impropriety; the DOE facility and program affected by the alleged misconduct; contract numbers; date(s) of alleged wrongdoing; how the caller is aware of the alleged impropriety; the identity of potential witnesses; and the identity and location of supporting documentation.


What happens when I report TO LBNL?

LBNL participates in UC's systemwide confidential, 24 hour hotline and online reporting service provided by Ethics Point. The service provides for a "call-back" that allows the Laboratory to ask questions of, or provide information to callers without compromising anonymity. Reports, which can be anonymous at the discretion of the caller, are distributed to the University of California Director of Investigations, LBNL's Locally Designated Official (Director of Institutional Assurance and Integrity), and the Internal Audit Department. The Laboratory will open an investigation if the report alleges an improper governmental activity (IGA) and there is sufficient information upon which to pursue an investigation. If the concern does not represent a potential IGA, the matter may be referred for a non-investigative review.
